Council Decision (EU) 2026/1172 of 24 February 2026 on the signing of the International Coffee Agreement 2022 THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(3) and Article 207(4), first subparagraph, in conjunction with Article 218(5) thereof, Having regard to the proposal from the European Commission, Whereas: (1) The Union is a Contracting Party to the International Coffee Agreement 2007 (the 2007 Agreement) and a member of the International Coffee Organization (ICO). The 2007 Agreement was concluded by the Union by Council Decision 2008/579/EC Council Decision 2008/579/EC of 16 June 2008 on the signing and conclusion on behalf of the European Community of the International Coffee Agreement 2007 (OJ L 186, 15.7.2008, p. 12, ELI: http://data.europa.eu/eli/dec/2008/579/oj). and entered into force on 2 February 2011. (2) On 28 July 2021, the Council authorised the Commission to open negotiations for amendments to the 2007 Agreement. (3) The negotiations were successfully concluded and the text of the International Coffee Agreement 2022 (the 2022 Agreement) was approved by the International Coffee Council at its 133rd Special Session on 9 June 2022. (4) The 2022 Agreement updates the balance of the voting and the contribution systems and addresses the integration of the private sector and civil society into the work of the ICO. The 2022 Agreement takes into account the objectives of simplification and streamlining while maintaining the intergovernmental nature of the ICO. (5) The 2022 Agreement is to replace the 2007 Agreement, which has been extended until 1 February 2028. The Union is a Contracting party to the 2007 Agreement, it is therefore in its interest to sign and conclude the 2022 Agreement. (6) Pursuant to the 2022 Agreement, the Union should, upon signature and ratification, declare its exclusive competence over matters governed by the 2022 Agreement and deposit a declaration with the Depositary. (7) Therefore, the 2022 Agreement should be signed and the Declaration of Competence attached to this Decision should be approved, HAS ADOPTED THIS DECISION:
Article 1
The signing of the International Coffee Agreement 2022 is hereby authorised, subject to the conclusion of that Agreement The text of the 2022 Agreement is not yet published in the Official Journal. .
Article 2
The Declaration of Competence required by Article 44(4) of the International Coffee Agreement 2022 attached to this Decision is hereby approved.
Article 3
This Decision shall enter into force on the date of its adoption. Done at Brussels, 24 February 2026. For the Council The President M. Raouna DECLARATION OF COMPETENCE OF THE EUROPEAN UNION IN ACCORDANCE WITH ARTICLE 44(4) OF THE INTERNATIONAL COFFEE AGREEMENT 2022 In accordance with Article 44(4) of the International Coffee Agreement 2022, the European Union declares that, in accordance with the Treaty on the Functioning of the European Union, the matters governed by the Agreement fall within the exclusive competence of the European Union under the common commercial policy and the Member States will therefore not be ratifying the Agreement.
